Artifactum Hosted — Terms of Service

These Terms are a legally binding agreement. By paying for Hosted, checking the box that you agree, or using an MCP URL we issue you, you accept them. If you are buying for an organization, you represent that you can bind it.

This is Hosted only (a vault stack we run). It is not Dedicated (a separate AWS account) and not a self-run module license.

1. What we provide

We will run, for your subscription, a dedicated Artifactum stack: its own compute function, object bucket, encryption key, and vector index, on infrastructure Estes controls. You get an MCP endpoint and credentials to store and recall Content Objects.

We do not give you an AWS account, the ability to transfer that account out of our organization, or a promise that Estes cannot read your objects. We operate the account. Support and abuse review may require decrypting objects. Do not store content you cannot allow Estes to access.

2. What you provide

A working email, a lawful use, and payment. You keep your credentials secret. You are responsible for what your agents and users store.

You will not use the Service to break the law, to store others’ confidential information without a right to do so, or to attack our systems or other tenants.

3. Fees and billing

Published prices: $49 per month or $490 per year (annual is two months free versus twelve monthly payments). Prices are in US dollars. Taxes extra if required.

Subscription renews until you cancel. Cancel anytime; you keep the Service until the end of the period you already paid. We do not prorate unused time on cancel, except:

  • If we fail to issue a working MCP URL within five business days after we successfully charge you for the first period, you may request a full refund of that first charge and this agreement ends.
  • If we withdraw the Service entirely, we refund prepaid unused time on a straight-line basis.

Fair use: 20 GB of stored content and embeddings for ordinary summaries. Extreme use (bulk re-embedding, large public egress, mining) may be throttled, paused, or quoted as overage. We will email you before a paid overage.

4. Isolation and security

Your stack is isolated from other Hosted customers by IAM and by a key that is yours on paper. It is not isolated from Estes Advisory. A compromise of the factory account could affect every Hosted tenant. Dedicated (separate AWS account, optional account transfer) is a different product.

We use industry-typical cloud controls. We do not claim SOC 2, HIPAA, or a BAA on Hosted unless a later writing says so.

5. Data, export, deletion

You own your Content Objects. While subscribed, you may export via MCP (list + get). After cancel or non-pay we may keep objects for up to 30 days for recovery, then delete them. We may keep billing records, logs without file bytes, and data the law requires.

Soft-delete in the product is not a legal hold. Do not treat Artifactum as a compliance archive unless we agree in a separate writing.

6. Service level

Hosted is best effort. No uptime percentage, no credits, no on-call. We will try to keep MCP up and to notice outages. Maintenance and AWS failures happen.

MCP client compatibility is as published on artifactum.ai/docs — not “works with every AI tool.”

7. Liability

To the extent the law allows, Estes is not liable for lost profits, lost data, or indirect damages. Our total liability under these Terms is the fees you paid us for Hosted in the three months before the claim.

We provide the Service “as is.” We do not warrant that it is error-free or fit for a particular purpose, except that we will provide the stack described in §1.

Nothing here limits liability that the law does not let us limit (for example, some personal-injury or fraud claims).

8. Suspension and termination

We may suspend or terminate immediately for non-pay, abuse, legal demand, or risk to other tenants. You may stop using the Service and cancel as in §3.

9. Changes

We may change these Terms or the price with 30 days email notice. If you do not agree, cancel before the change takes effect. Continued use after the effective date is acceptance of the new Terms. Price changes apply to the next renewal, not the period already paid.

10. Law

Texas law, without conflict-of-law rules. Courts in Texas, USA, unless the law requires otherwise. The UN Convention on Contracts for the International Sale of Goods does not apply.
